{"id":12,"date":"2018-12-12T22:53:24","date_gmt":"2018-12-12T22:53:24","guid":{"rendered":"https:\/\/sacramentofamilylawlawyers.com\/?page_id=12"},"modified":"2019-12-27T19:36:15","modified_gmt":"2019-12-27T19:36:15","slug":"reduced","status":"publish","type":"page","link":"https:\/\/sacramentofamilylawlawyers.com\/child-support\/reduced\/","title":{"rendered":"Reduced Child Support"},"content":{"rendered":"\n<p>It\u2019s possible to obtain a child support order below the amount calculated by the State Uniform Guideline. &nbsp;Family Code Section 4057 lists certain instances in which the court can order a child support award below the Guideline amount. &nbsp;Among the instances listed is a stipulation between the parties for a different <a href=\"https:\/\/sacramentofamilylawlawyers.com\/child-support-duration-amount\/\">amount of child support<\/a> that satisfies the requirements of Section 4065.<\/p>\n\n\n\n<p>Section 4065 conditions court approval of stipulated child support agreements that deviate from the amount established by the Guideline upon the parties declaration of the following:<\/p>\n\n\n\n<ol><li>The parties are fully informed of their rights concerning child support<\/li><li>The order is being agreed to without coercion or duress<\/li><li>The needs of the children will be adequately met by the stipulated amount<\/li><li>The agreement is in the best interests of the children &amp;<\/li><li>The right to support has not been assigned to the County pursuant to Section 11477 of the Welfare and Institutions Code and no public assistance application is pending. <\/li><\/ol>\n\n\n\n<p>In addition to the aforementioned declarations, court approval is conditioned upon the <a href=\"http:\/\/dcss.saccounty.net\/Pages\/default.aspx\">local child support agency<\/a> signing the stipulation if the child support agency is providing enforcement services. &nbsp;If the children are receiving CalWORKS benefits, there is a pending application for public assistance, or the parent receiving support has not consented to the order, the child support agency cannot sign the stipulated agreement.<\/p>\n\n\n\n<p>Unfortunately for the party gaining the benefit of a stipulated child support amount below the Guideline amount, the order can be modified in the future without a showing of changed circumstances. \u00a0As a result, either party through their <a href=\"https:\/\/sacramentofamilylawlawyers.com\/\">family law attorney<\/a> can seek modification of the stipulated order in favor of the Guideline amount or higher. <br><\/p>\n","protected":false},"excerpt":{"rendered":"<p>It\u2019s possible to obtain a child support order below the amount calculated by the State Uniform Guideline. &nbsp;Family Code Section 4057 lists certain instances in which the court can order a child support award below the Guideline amount. &nbsp;Among the instances listed is a stipulation between the parties for a different amount of child support [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":0,"parent":16,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"_uf_show_specific_survey":0,"_uf_disable_surveys":false,"_genesis_hide_title":false,"_genesis_hide_breadcrumbs":false,"_genesis_hide_singular_image":false,"_genesis_hide_footer_widgets":false,"_genesis_custom_body_class":"","_genesis_custom_post_class":"","_genesis_layout":"","footnotes":""},"_links":{"self":[{"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/pages\/12"}],"collection":[{"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/pages"}],"about":[{"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/types\/page"}],"author":[{"embeddable":true,"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/comments?post=12"}],"version-history":[{"count":5,"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/pages\/12\/revisions"}],"predecessor-version":[{"id":530,"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/pages\/12\/revisions\/530"}],"up":[{"embeddable":true,"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/pages\/16"}],"wp:attachment":[{"href":"https:\/\/sacramentofamilylawlawyers.com\/wp-json\/wp\/v2\/media?parent=12"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
